Thanks for using oh!shoot. These terms are the ground rules between you and us. We wrote them in plain language, but they are a legal document, so please read them before you sign up.
Article 1 (Purpose)
These terms set out the rights, duties and responsibilities between [Company name] (“we”, “us”) and the people who use the oh!shoot service (the “Service”), and the conditions and procedures for using it.
Article 2 (Definitions)
- Service: the web service that links a video to a printed item (photo, magnet, card, poster and so on) and plays that video on the print in the web browser of anyone who scans its QR code, together with its related features (the studio, print-ready files, analytics and so on).
- Member: an individual or business that agrees to these terms and creates an account.
- Workspace: the unit in which a member manages live prints, team members and billing. Workspaces are personal or business.
- Live print: the bundle of a video, a print design and a QR code tied to one printed item. Once a member publishes it, it plays through the QR code.
- Credit: the unit used to publish live prints. One credit publishes one live print.
- Viewer: a person who scans a QR code and opens the viewer. Viewers do not sign up.
- Member content: everything a member uploads or creates, such as videos, photos, print designs, text and contact-button details.
Article 3 (Posting and changing these terms)
- We post these terms on the Service website (this page).
- We may change these terms to the extent permitted by law.
- When we change them, we announce the effective date, what changed and why on this website, in the studio or by email at least 7 days before the change takes effect (30 days for changes that are unfavourable to members or otherwise significant).
- If you do not agree to the changed terms, you may close your account before the effective date. If you keep using the Service afterwards, you are treated as having agreed. The announcement will say so.
Article 4 (Forming the agreement)
- The agreement is formed when a person agrees to these terms and the Privacy Policy, applies to sign up, and we accept the application.
- You can sign up with an email address (sign-in link or password) or a Google account. Depending on how we run the Service, we may limit sign-up to invited or approved people.
- We may refuse or end an account if the person used someone else’s information, gave false information, was previously restricted for breaking these terms, or if there is a serious risk to running the Service.
- People under 14 may not sign up. A minor under 19 needs a legal guardian’s consent to make a paid purchase.
Article 5 (Accounts and workspaces)
- Give accurate information and keep it up to date.
- Keep your sign-in methods (email link, password, Google account) safe. Do not lend or transfer your account. If you find out it was used by someone else, tell us right away.
- In a business workspace, an admin can invite members and grant permissions. The workspace’s member is responsible for the content and actions of the people it invites.
Article 6 (The Service, changes and interruptions)
- We provide features such as uploading videos and print designs, marking where the video sits, making and publishing live prints, print-ready files and QR codes, replacing videos, turning playback on or off, and analytics. You can replace the video behind the same QR code at any time.
- Recognition and playback quality depend on the viewer’s phone, browser, camera permission, lighting, print quality and connection. We do not promise it works identically on every device every time.
- We may pause the Service for maintenance, outages, natural disasters or failures at outside providers (hosting, authentication, payments and so on). We will tell you in advance when we can, and afterwards when we cannot.
- We may change or remove features to improve the Service. If a paid feature changes significantly or the Service ends, we will give 30 days’ notice and settle the remaining paid period or credits fairly, for example by refund.
Article 7 (Free trial, pricing, credits)
- When you sign up, you get a 14-day free trial with 5 trial credits. No card is needed.
- Live prints made during the trial pause (they are not deleted) when the trial ends unless you upgrade. They play again once you upgrade.
- Prices are below and are charged in US dollars (USD). A change in price or contents does not affect a period you have already paid for; it applies from the next payment.
| Item | Price | Credits | Notes |
|---|---|---|---|
| Monthly subscription | $24.99 / month | 25 each month | No rollover |
| Yearly subscription | $249 / year | 300 | No rollover |
| Lifetime | $2,499 (one time) | 3,000 | Granted once |
| Extra credits | $1 each | As many as you buy | Never expire |
- One credit publishes one live print. Replacing the video of a published live print costs no extra credit.
- Credits from monthly and yearly plans are refilled each period; unused ones do not carry over. Extra credits you buy and referral bonus credits never expire. When you publish, plan credits are used first, then extra credits.
- If you cancel or your subscription ends, live prints you already published on a paid plan keep playing while your account stays open. Publishing a new live print needs an active plan or credits.
- “Lifetime” means for as long as we operate the Service. If we end the Service, Article 6(4) applies.
- There are technical limits, such as video length (30 seconds on trial, 180 seconds on paid plans), file size (video 500 MB, image 40 MB) and print size (20 mm to 1,000 mm per side). The Service shows them.
Article 8 (Payment and renewal)
- Payments are handled by our payment processor, Stripe, Inc. Stripe receives and processes your card details directly; we do not store full card numbers.
- Monthly and yearly subscriptions renew automatically on the same cycle until you cancel, and the renewal is charged to your saved payment method. To stop renewal, cancel on the studio’s billing page before the next payment date.
- If you cancel, you can use the Service until the end of the period you already paid for, and you will not be charged again.
- Whether displayed prices include tax, and how receipts and tax invoices are issued, follow what the checkout page shows.
- If a payment fails we may notify you and retry, and we may end the subscription if it is not resolved within a reasonable time.
- Refunds and withdrawal follow the Refund Policy.
Article 9 (Rights in member content, and licence)
- Rights in member content stay with the member who made it or with the rightful owner. We do not take ownership of member content.
- You grant us a non-exclusive, royalty-free licence to store, copy, convert (video processing, print files and AR data), transmit, display and play your member content, only as needed to provide the Service. The licence ends when the live print or account is deleted and the retention period has passed.
- You confirm that you own, or have all needed permission for, the copyright, portrait and publicity rights and personal-data consent for the videos, photos, music, text, and people’s faces and voices you upload.
- If a third party raises a claim about your content, you will help us resolve it, and you are liable for losses we suffer because of your fault.
Article 10 (Prohibited conduct and content rules)
You must not:
- upload or publish content that is illegal or used for crime;
- upload content that infringes others’ copyright, portrait rights, trademarks, personal data or other rights;
- upload sexual content, sexual exploitation of children or minors, content inciting violence or hatred, defamation, threats, stalking or other content that harms people;
- upload fraud, phishing, malware, or contact buttons meant to trick people into giving up personal data;
- upload videos of people filmed without consent, or covertly filmed material;
- hack the Service, overload it with abnormal requests, mass-register with automation, or repeatedly abuse the free trial;
- copy or reverse-engineer the Service or its source code to build a competing service (except where the law allows it);
- sell or lend accounts, or otherwise break these terms or the law.
Article 11 (Who can see your live prints)
- Prints pass through many hands and a QR code can be photographed and shared, so decide for yourself whether it is fine for anyone to see the video you connect to a print.
- Do not upload personal data, trade secrets or sensitive footage that others must not see.
- Turning playback off stops the video from playing, but we cannot erase data a viewer’s device has already cached temporarily.
Article 12 (Complaints and action on content)
- If you find content that infringes your rights or breaks these terms, report it to hello@ohshoot.net. Please include the address of the live print (or the short code of its QR code), the right that was infringed and why, and your name and contact details. For a copyright complaint, please include proof that you are the rights holder.
- When we receive a valid complaint, we take the action needed, such as pausing or removing the live print first, and tell the member what happened and why. The member can respond, and we review the response to decide whether to restore it.
- We may pause or remove content that clearly breaks the law or Article 10 even without a complaint. In urgent cases we act first and tell the member afterwards.
- We may restrict or close the accounts of members who repeat violations.
Article 13 (Restrictions and ending the agreement)
- You can end the agreement at any time. To close your account, email hello@ohshoot.net. If you have a paid subscription, cancel it first on the studio’s billing page so you are not charged again.
- If you break these terms, we may take action in steps: a warning, removing content, limiting features, then ending the agreement. For serious violations or legal risk we may end it immediately, and we will tell you why.
- When an account is closed, the member’s live prints stop playing, and the account and member content are deleted within the periods in the Privacy Policy, except records we must keep by law.
- Refunds follow the Refund Policy. If we ended the agreement because you broke these terms, we may not refund.
Article 14 (Our intellectual property)
Rights in the Service’s software, design, trademarks, logos and documents belong to us or the rightful owners. You may use them only as needed to use the Service and may not copy or distribute them without our prior written consent.
Article 15 (Limits of liability)
- We work to keep the Service reliable, but we are not responsible for interruptions or data loss caused by natural disasters, power cuts, failures at telecom or cloud providers, or other causes beyond our control, unless we acted intentionally or with gross negligence.
- We are not responsible for the content members upload, whether it is lawful, or disputes between members and third parties (including viewers). Where we received a complaint and failed to act, the law applies.
- To the extent the law permits, our liability is limited to the total fees that the member paid us in the 12 months before the loss arose. This limit does not apply to loss caused by our intent or gross negligence, or to liability the law does not allow us to limit.
- The free trial and beta features are provided as they are, and our liability for them may be limited to the extent the law permits.
- Nothing in these terms reduces the rights that the law (for example the Korean E-Commerce Act and Standard Terms Act) guarantees to consumers.
Article 16 (Privacy)
We handle the personal information of members and viewers with care. The Privacy Policy explains in detail.
Article 17 (Disputes and governing law)
- We will first try in good faith to resolve disputes by talking. Send questions and complaints to hello@ohshoot.net.
- If that does not work, you may apply for mediation, for example to the Korea Consumer Agency or the Electronic Commerce Dispute Mediation Committee.
- These terms are governed by the laws of the Republic of Korea. Lawsuits go to the court that has jurisdiction under the Korean Civil Procedure Act.
Addendum
These terms take effect on [YYYY-MM-DD].
